According to the representative of Off – White, this line is representative and characteristic of the fashion house. They express the liberal spirit, bold street style of the fashion house.
However, attorneys for the US Patent and Trademark Office argued that this phrase merely describes the features and characteristics of the product, not expressing any distinctive features of this design. Therefore, they refused that Off – White wanted to register the protection of this line.
In this case, if the fashion brand still wants to complain, they can file an appeal and provide additional evidence and arguments to prove the intellectual property rights.
Off – White was born in 2012 by Virgil Abloh – Creative Director of menswear segment of Louis Vuitton. The Italian brand targets the high-end street fashion segment.
